You must be at least 16 years old and capable of forming a binding contract to use the Service. By using Kavanah, you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

To access the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Kavanah allows you to create and participate in workspaces. Workspace administrators control membership, permissions, and workspace settings. You agree to use workspaces in accordance with any policies set by your workspace administrator and these Terms.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Upload or transmit malware, viruses, or other harmful code
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service
• Scrape, crawl, or harvest data from the Service without permission
• Use the Service to send unsolicited communications, spam, or phishing attempts
• Impersonate another person or entity, or misrepresent your affiliation

We reserve the right to suspend or terminate accounts that violate these rules.

You retain ownership of all content you create, upload, or share through the Service ("Your Content"). By using the Service, you grant us a limited, worldwide, non-exclusive license to store, process, and display Your Content solely to provide and improve the Service. We will not use Your Content for advertising or sell it to third parties.

You are solely responsible for Your Content and represent that you have all necessary rights to share it through the Service.

The Service, including its design, features, code, documentation, and branding, is owned by Kavanah and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand elements without prior written consent.

Certain features of the Service may require a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled in accordance with our refund policy.

We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that affect your use.

You may close your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. We will make your workspace data available for export for 30 days following termination, after which it may be permanently deleted.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

To the maximum extent permitted by law, Kavanah shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Kavanah, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Kavanah operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
